Public Consultation about Frequency Bands of Radio Spectrum for Fifth Generation (5G) Mobile System

Objective

The Federal Telecommunications Institute (Institute) convinced of the importance and relevance of transparency and citizen participation in the elaboration and application of its regulations, as well as in making decisions on various matters of general interest, will receive comments, opinions and contributions from any interested party regarding the Frequency Bands of Radio Spectrum to Fifth Generation (5G) Mobile Systems, based on the provisions of articles 15,  XLIII, 54 and 56 of the Federal Law of Telecommunications and Broadcasting (LFTR), and 27, 28, I and XX, and 30, XI, of the Organic Statute of the Federal Telecommunications Institute.

By virtue of the foregoing, the purpose of this public consultation is to gather comments, opinions or contributions that allow the Institute to determine future actions in the field of planning and administration of the radio spectrum, in relation to the frequency bands for fifth generation (5G) mobile systems.

Public Consultation Guidelines

The Institute makes available to all those interested in participating in this consultation process, the study called “Panorama del espectro radioeléctrico en México para los servicios móviles de quinta generación”, prepared by the Radioelectric Spectrum Office of the Institute (UER), is a reference document, which is not in consultation but through it is intended to provide an overview of the frequency bands that the Institute considers feasible for the deployment of 5G mobile systems in Mexico. Likewise, the “Questionnaire about Frequency Bands of Radio Spectrum for Fifth Generation (5G) Mobile Systems” is made available, so that, through the latter, comments may be sent to this autonomous constitutional body, opinions and contributions on each of the questions raised there, including the possibility of collecting any input of relevant information related to this topic.

In this regard, the Institute will receive comments, opinions and/or contributions related to the Questionnaire about Frequency Bands of Radio Spectrum for Fifth Generation (5G) Mobile Systems, through the following email: consultapublica5G@ift.org.mx, or, through a document submitted to the Common Filing Office of the Institute, located in Insurgentes Sur 1143, colonia Nochebuena, Alcaldía Benito Juárez, zip code 03720 Mexico City, Mexico; Monday thru Thursday, from 9:00 to 18:30 hours and Friday from 9:00 to 15:00 hours

The information that the interested parties send to the Institute - in accordance with the deadlines and terms described in this mechanic - in relation to this consultation process will not be binding, notwithstanding that the Institute may weigh it in a document that reflects the results of said consultation, which will be made public in this section, prior to the Plenary of the Institute making a determination on this matter.

Upon conclusion of this consultation process, the Institute will not receive any more comments, opinions or contributions, since this process will be deemed as finalized and closed.

In case that the information related to this consultation process is submitted to the Institute in behalf of another person, either a legal entity or an individual, a simple copy of the document to accredit such representation shall be attached electronically, otherwise, the request will be understood and recorded in this section as being submitted in the sender’s own behalf.

Any information unrelated to the subject of this consultation process will not be considered or published.

The information, comments, opinions, contributions or other elements of analysis that the Institute receives in relation to this Public Consultation, will be published in full on its Internet portal in accordance with the provisions of the Eighth of the Guidelines Public Consultation and Impact Analysis Regulatory of the Federal Telecommunications Institute and, in that sense, will be invariably considered public except as provided in the Federal Law of Transparency and Access to Public Information, the General Law of Transparency and Access to Public Information, as well as in the Law General Protection of Personal Data in Possession of Mandated Subjects and the General Guidelines for the Protection of Personal Data of the Public Sector.

In accordance with the provisions of the “Agreement through which the Plenary of the Federal Telecommunications Institute approves its annual calendar of ordinary sessions and the annual calendar of work for the year 2019 and early 2020”, work is suspended at the Institute on the day September 16, 2019, including Saturday and Sunday, being considered non-working.

By virtue of the foregoing, during the period of suspension of work of the Institute, you may send your comments, opinions and contributions related to this public consultation, through the email account enabled for such purposes, and these will be received and Registered by this autonomous constitutional body, as of September 17, 2019, in accordance with the provisions of article 29, third paragraph, of the Federal Law of Administrative Procedure.
